Terms of Service

By creating an account or using WayPhoto (the “Service”) you agree to these Terms of Service. If you do not agree, please do not use the Service.

You sign in with a Google account and are responsible for activity that happens under it. You must be at least 13 years old, or the minimum age of digital consent in your country, to use the Service.

Image generation is paid for with credits. Each generation costs 10 credits. Credits may be obtained through a subscription, purchased in packs, or granted promotionally.

Subscription credits are reset — not accumulated — at the start of each billing period, so unused subscription credits do not roll over. Credits bought in packs do not expire while your account is active. Payments are processed by Stripe; we do not store your card details.

If a generation fails for technical reasons, the credits for that generation are automatically returned to your balance. Credits have no cash value and are not redeemable for money.

You may cancel a subscription at any time from your account page; it remains active until the end of the paid period. Except where required by law, payments are non-refundable.

You keep ownership of the photos you upload and of the images the Service generates for you. You grant us a limited licence to process, store and transmit your photos strictly for the purpose of operating the Service. You confirm that you have the right to upload each photo, and that doing so does not infringe anyone else’s rights.

You agree not to use the Service to:

• upload photos of other people without their permission, or of anyone under 18 in any intimate or suggestive context;
• create sexual, hateful, harassing, deceptive or unlawful imagery;
• impersonate a real person or produce material intended to mislead;
• attempt to bypass credit limits, rate limits or any other technical restriction.

We may suspend or terminate accounts that breach these rules.

Results are produced by third-party machine-learning models and are inherently unpredictable. We do not guarantee that any particular generation will meet your expectations, and outputs are provided “as is”.

We aim to keep the Service running but do not guarantee uninterrupted availability. We may change, suspend or discontinue any part of it. If we discontinue the Service entirely, we will make reasonable efforts to give you notice and time to download your images.

To the fullest extent permitted by law, WayPhoto is not liable for any indirect, incidental or consequential damages. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.

We may update these terms from time to time. Material changes will be communicated through the Service. Continuing to use WayPhoto after a change means you accept the revised terms.
